Can an employer get released with releasing the employee?

Hi all,
I have a work-related question. If a person has worked for a sole establishment company in Dubai, which means operations and management with the expat under the sponsor. Now, the employee has claims from the company. In this case, the expat owner seeks a release from the sponsor as he is about to join a company in a senior post. But he has not given a release to his employee yet.
Will he or can he get a release from the sponsor without releasing the employee? The company owes the employee his salary dues since joining the company in November 2006.

Dear Vaidhee,
A compnay who does not pay salaries on time and labour related disputes will suffer legal implications if reported by employee. If proved the employee will be given chance to work with new company without any ban and also his dues will be piad by the company. It has been practised at serveral instance by labour department.
Further, There is always mutual understanding between disgrantled staff & employer which leads to any conculusion at labour office/human rights office/labour court.
Thefore, first of all it should be reported legally to official to proceed for any claim.
